Federal Judge Voids Public Transport Mask Mandate in Florida

Judge Kathryn Kimball Mizelle called the Biden Administration’s mask regulation “unlawful,” despite the government’s attempts to prevent the spread of COVID-19.

Mizelle claimed that “the Mandate exceeded the CDC’s statutory authority, improperly invoked the good cause exception to notice and comment rule making, and failed to adequately explain its decisions.”

The US Centers for Disease Control and Prevention (CDC) prolonged the mask mandate in Florida through May 3, 2022, as the number of COVID-19 cases increased since April across the country.

Following the judge’s ruling, American Airlines, Delta, and Alaska Airlines shared that they will not force passengers to wear masks on board.

For more information on the case, see the order by the US District Court for the Middle District of Florida.
