Former Senate Candidate Challenges NY Assembly Electoral Redistricting Map

Gary Greenberg and his legal counsel Jim Walden sued Gov. Kathy Hochul and officials for protecting “Democratic incumbents” in New York electoral districts.
According to the memorandum filed by Greenberg, the adoption of the current State Assembly map is based on the same unconstitutional procedure. The Court of Appeals did not provide any help in the map redistricting because the present petitioners had not requested any aid previously. In addition, the Court of Appeals offered to provide a third-party redistricting expert who would observe the whole process over the congressional and State Senate maps.
Greenberg also addressed the following requirements to the Court:
- Delay the election date from Jun 28 to August 23, 2022, to enable the district map redrawing in alignment with New York State Constitution;
- Mail Assembly ballots to the US military personnel serving overseas by July 8, 2022;
- Enable a petitioning period for every race to seek the required election office based on the new redistricting locations.
Any petition challenging the state’s redistricting must be delivered to the attorney general, Senate president, Assembly speaker and governor.
