West Virginia Elder Law Lawyers

Frequently Asked Questions

Is elder law a recognized specialty?

The National Elder Law Foundation (NELF) offers certification in elder and special needs law and is the only national organization that does so.

Are there alternatives for managing property when a person becomes incapacitated?

There are various alternatives. An alternative is a court-supervised proceeding, also known as guardianship. This is not a great option for most people, however. If it’s just the person’s home, the person is eligible for a few Social Security benefits to care for the person at home.

What is a living will?

A living will is a document incorporated into a medical power of attorney, and you give directions for the appointment of an agent if the need for life-sustaining treatment arises and you can’t communicate your wishes later on. This agency and its nature make your elder lawyer a very viable candidate.
